Warranty
The Purchaser shall rigorously examine the goods fulfilled by us directly after delivery to the Purchaser or a third party named by him. The goods outfitted by us shall be considered to have been approved if we are not in receipt of a written notice of injuries concerning apparent or other injuries which were identified using an immediate check within seven working days after shipment of the goods or within seven working days after the discovery of the injury, otherwise, any earlier date on which the injury was identifiable by the Purchaser as regular use of the product without any closer inquiry. The refused goods shall be returned to us to be examined at our application. Suppose the notice of defects turns out to be false. In that matter, the Purchaser shall be required to refund the expense incurred for the inspection unless the Purchaser is not liable for the false notice of defects. We will reimburse the least expensive dispatch route costs in the matter of a substantiated notice of injuries. The latter shall not appeal if the costs increase because the goods are in a location other than the assigned use location, which results in irregular costs for us.
A shipment of used goods allowed in a particular case with the Purchaser is affected to the refusal of any warranty. The Purchaser cannot charge warranty requests.
If claims are declared against the Purchaser by a customer or connected with an entrepreneur's appeal due to a fault in the goods, the Purchaser shall notify us of this without pause. Appeal against us shall only be possible to the extent that the Purchaser has a right to declare warranty claims for injuries against us in point of these General Terms and Conditions. If claims are declared against the Purchaser by his customer based on terms that deviate from the defect above warranty terms or takes back an item out of goodwill, these agreements shall only apply between the Purchaser and his customer; appeal against us is not possible in this respect.
LIMITATIONS & EXCLUSIONS
In addition to any other limitations and exclusions in this warranty, what else does not cover:
- Defects, failures, damages or performance limitations
- Alterations or Modifications to any part of products.
- The Seller is not liable for any direct or indirect loss due to the ordered goods are too late to the Buyer, or the defects appear in the ordered goods or the ordered goods are defective when delays or defects are caused by Buyer act or Force Majeure events beyond OPTIDIAG control.
- Failure or defects due to accident
